Lex 8256: The Law in Cyberspace
Seminar
The Big Picture
Please read these six pieces,
which present opposing views on the nature of the Internet and the law that
can or should regulate it. All are relatively short. (I've listed
below, under "OPTIONAL," two classic articles that I bypassed in favor of
shorter, more readable ones.) I won't be making a presentation at
the start of class; just come prepared to talk.
- John Perry Barlow, A Declaration
of the Independence of Cyberspace (Feb. 9, 1996)
- David Post, The Cyberspace
Revolution (July 9, 1997)
- Larry Lessig, The
Zones of Cyberspace, 48 Stan. L. Rev. 1403 (1996)
- Jack Goldsmith, The
Internet and the Abiding Significance of Territorial Sovereignty, 5 Ind.
J. Global Leg. Stud. 475 (1998)
- David Post, Against 'Against
Cyberanarchy' (forthcoming, Berkeley Tech. L. J.)
- Phil Agre, Cyberspace as American
Culture, 11 Science as Culture 171 (2002)
Also, look back over the semester. What have
you learned? Have your views changed? Be prepared to talk about
that too.
