I was able to find no state or federal cases in which RFID privacy was
litigated. The frequently litigated issue with regard to RFID
currently is intellectual property rights. I did find this
excerpt from
having to do with inmate rights concerning strip searches. The
prison officials are seeking funding to institute an RFID system: "In
an effort to strengthen IPC operations still further, DOC is requesting
capital funds in FY 07 to install a wireless LAN at the DC Jail and an
RFID system. The latter system will allow DOC to track inmate movements
and locations electronically, conduct real-time counts, and assure
positive identification."
